Dispute Boards

 

In cases where the Parties agree to include a reference to the Dispute Board Rules adopted by the Danish Institute of Arbitration, the Institute recommends the following standard clause to be included in the contract:

”The Parties hereby agree to establish a Dispute Board in accordance with the Dispute Board Rules adopted by the Danish Institute of Arbitration and in force at the time when such proceedings are commenced. The Dispute Board has the task of assisting the Parties in resolving disputes which may arise between the Parties during the performance of this contract.

If the proceedings according to the Dispute Board Rules are terminated without a settlement, the dispute shall be settled by arbitration administrated by The Danish Institute of Arbitration in accordance with the rules of arbitration procedure adopted by The Danish Institute of Arbitration and in force at the time when such proceedings are commenced.”
