In cases where the Parties agree to arbitrate disputes under the Danish Institute of Arbitration, the Institute recommends the following standard clause to be included in the contract:

“Any dispute arising out of or in connection with this contract, including any disputes regarding the existence, validity or termination thereof, shall be settled by arbitration administrated by The Danish Institute of Arbitration in accordance with the rules of arbitration procedure adopted by The Danish Institute of Arbitration and in force at the time when such proceedings are commenced.”

Drafters of arbitration clauses may wish to go more into details and to take into account the following additions:

  • “The arbitral tribunal shall be composed of three arbitrators.”
  • “The place of arbitration shall be […].”
  • “The language to be used in the arbitral proceedings shall be […].”
  • “This contract shall be governed by the substantive law of […].”
