Express Arbitration
The DIA has adopted new Rules for Express Arbitration. Parties often request quicker and more cost-effective means of dispute resolution. These express rules aim to respond to this request, without compromising fundamental principles of arbitration. They are primarily for the resolution of low-value disputes.
Innovatively, for less complex cases, the rules contain an option for each party to submit a reasoned proposal stating how the dispute should be resolved and for the Arbitral Tribunal to confirm the most reasonable proposal as an award by consent.
